Looks like our Nevada AG seems to have forgot she represents Nevada and it's laws.
From the Reno Gazette Journal: Nevada Attorney General Catherine Cortez Masto said Friday she will reconsider a brief she filed earlier this week defending Nevada’s gay marriage ban, saying her constitutional arguments are “likely no longer tenable” in light of a 9th U.S. Circuit of Appeals opinion finding it unconstitutional to exclude jurors based on sexual orientation.
On Tuesday, Masto, a Democrat, filed the brief on behalf of Republican Gov. Brian Sandoval defending Nevada’s gay marriage ban, which is being challenged in a lawsuit filed by Lambda Legal Defense and Education Fund on behalf of several same-sex Nevada couples.
Lamba Legal lost that lawsuit at the district court level and has appealed to the 9th Circuit.
Both Masto and Sandoval have come under political fire from civil rights groups this week for defending the state’s case in the lawsuit against the same-sex marriage ban.
“The case made here is that the State of Nevada’s marriage law is constitutional because it serves the legitimate purpose of preserving traditional marriage,” Masto’s solicitor general wrote in the brief.
On Friday evening, Masto released a statement saying she is reviewing the brief in light of the 9th Circuit’s opinion in SmithKline Beechum Corp. v. Abbott Laboratories. http://www.rgj.com/article/20140124/NEWS/301240052/Nevada-Attorney-General-backs-off-defense-state-s-gay-marriage-ban
I used to like Cortez-Masto but now she is just another liberal Democrat hack.
Her job is to represent Nevada and it's laws, whether she agrees with the law or not.
Now, Nevada will have to hire an outside attorney to represent it and that will cost thousands of dollars and probably hundreds of thousands of dollars.
When Cortez-Matso was first elected, she had promise that she would be a good AG. Instead, she has been a Democrat hack, who brings false charges against GOP politicians even before Eric Holder thought about it. She now refuses to defend the State of Nevada, even though she is legally supposed to.
The good thing is that she has opponents in the next election and she will soon be a former Attorney General looking for a job.
