From the San Francisco Chronicle: A groundbreaking California law banning therapy that seeks to change
the sexual orientation of gay and lesbian youths has been challenged in
court by Christian conservatives who say it tramples on families' rights
and therapists' consciences.
The law, signed Saturday by Gov. Jerry Brown
and scheduled to take effect Jan. 1, prohibits licensed therapists and
counselors from engaging in "sexual orientation change efforts" with
anyone under 18. Violators would be subject to discipline by state
licensing boards.
Supporters, including gay rights advocates and
statewide groups of psychologists and family therapists, say the
"reparative" therapy is both deceptive and dangerous, leading to
depression and self-destructive behavior. They note that major mental
health organizations stopped classifying homosexuality as an illness or
disorder decades ago.
But in a lawsuit Monday, attorneys for two
religiously oriented therapists and a therapy student - described as
someone who has successfully undergone treatment for same-sex
attractions - said the law would intrude on free speech, privacy and
freedom of religion.
If a youth has "unwanted same-sex behaviors
or attractions," the state would prevent therapists from using their
"independent professional judgment" to choose the appropriate treatment -
effectively requiring them to discriminate on the basis of sexual
orientation, the suit said.
