Outrage In Pahrump: Stabbing Victim Jailed For Refusing Drug Test

Pahrump and Nye County, which is about 60 miles from Las Vegas has been the scene of some outrageous behavior in the past year. From the Sheriff who jailed a mother who lost her 3 children in a fire to a man getting up to 25 years for spitting (overturned by the Supreme Court of Nevada) to special education teachers and aides charged with child abuse, which still has not gone to trial.
Well, get ready for another round of bizarre Nye County Court news. A stabbing victim, who was stabbed 19 times, was in court to testify in a preliminary hearing for a murder suspect. Apparently, the defense attorney, acting like most most attorneys- acting like a jackass, decided he could not understand what the victim had said, so he threw out the possibility that the victim was on Meth, with no evidence and moved to have the victim drug tested. the stupid ass judge agreed and ordered a drug test and when the victim refused, the stupid ass judge threw the victim, who had been stabbed 19 times and was on pain killers, which is understandable, in jail for contempt of court. We still don't know if the victim is still in jail.
From the Pahrump Valley Times: The surviving victim from a May 1 double stabbing that cost one Pahrump man his life was arrested Friday afternoon in Pahrump Justice Court.
Antionette Bell, 21, was charged with contempt of court for refusing to take a drug test after defense attorneys for her alleged attackers complained that her testimony was increasingly incoherent.
The stunning turn of events occurred at the end of a full day of testimony in the ongoing preliminary hearing for four suspects charged in connection with Bell’s attack and the stabbing death of 56-year-old Michael Frasher.
Troy Jackson, 38, Victoria Garcia, 38, Michael Maxwell, 34, Tiffany Rubio, 28, and Charles Eubanks, 22, all of Pahrump, were arrested on May 2 on charges of murder, attempted murder, conspiracy to commit a crime, battery with a deadly weapon and being under the influence of a controlled substance....
Judge Tina Brisebill ordered Bell to take a drug test after Jackson’s attorney, Harry Gensler, aired his suspicion that Bell was testifying under the influence of drugs, which is a felony in Nevada.
“Are you on meth today? Are you under the influence of anything?” Gensler asked Bell after more than an hour of questioning her.
She said no.
“Would you be willing to submit to a drug test to determine that?” he retorted.
Bell gave an incoherent answer, attempting to explain that the case was about murder and not meth and that she needed to get the conversation back on topic.

So, without any evidence, the scum defense attorney implied that the victim was under the influence of meth. The scum attorney had no proof of meth use, mind you, but it was thrown out there to make the victim look bad.
Further, to see the slant of the story by the writer of the author, see if this makes sense: Bell gave an incoherent answer, attempting to explain that the case was about murder and not meth and that she needed to get the conversation back on topic.
If the victim in this case, Ms. Bell, gave an incoherent answer, how did the writer of the article understand her to state what she was saying? Seems like a coherent statement to me.
Finally: Still recovering from multiple stab wounds – Bell testified Friday that she was stabbed 19 times, though she testified on June 3 that it was 32 times – she told the judge she had a prescription for Oxycodone and that she’d taken her last pill at 6 a.m.
Gensler made a motion to strike all of Bell’s testimony, both from Friday’s hearing and from her previous appearance on the witness stand.
“She’s certainly exhibited the effects of being under the influence, whatever that may be,” he said. “If she’s not willing to abide by the rules of the court then the court shouldn’t consider any of her testimony.”
The judge said the testimony would stay for now, but arguments for striking it could be entertained later.
Brisebill, after hearing again from Vitto and then from the other defense attorneys, considered another request from Gensler, this time to hold Bell in contempt of court and take her to jail until a blood test could be administered.
The judge granted the motion and ordered Bell into custody.
Bell started wailing in court and was later taken away in handcuffs, as her accused –and bemused – attacker and accomplices watched.

So, a victim of a stabbing, in which she was stabbed 19 or more times and is on pain medication is subjected to abuse by not only the attorney but the judge and prosecutor as well. This apparently is justice in Nye County.

  1. As one who knows I feel that you should be one of the persons that has to sit in the court room and listen to her. You would then understand why the attorneys and judge came to that conclusion.....

    I am used to listening to people with speech problems, so I am used to listening to people with bad speech.
    What I have a problem with is the defense attorney who threw out the meth accusation without any evidence.
    I also had a problem with the Pahrump paper who said the lady was incoherent but yet was able to understand what she was saying.
    Finally, she was the victim and should have been given a huge break instead of throwing her in jail.
    What this will do is cause more victims not come to court because they may fear that they may end up in jail.

    1. I am also a victim to a wrongful arrest and being locked up for a year for someone telling a lie. Having no opportunity to even say my side of the wrongful accusation made against me, I believe the state if Nevada should be brought to court and sued. Enough of us "victims" getting together on stuff like this needs to happen so this crap stops by those in higher positions that really shouldn't be. They do not do their jobs correctly or fairly. Shared Dockert and Jason Earnst both should be re evaluated by the bar. In fact I'm going to raise up a complaint with the NV bar association on these two stupid and power hungry individuals. Email me if you care to talk more on this subject. I hate that town and the people in it. Horrible what happened to this girl. She's right, she's the victim here and at that point drugs aren't the issue. Who cares. She can do what she wants. Its about murder.

    I happen to be very close to Antionette, I have known her since she 10. She had a very hard childhood, in and out of foster homes.

    What she has been through has caused her severe emotional stress, constantly reliving the nightmare of her friend Michael Frasher and herself being stabbed over and over,and left for dead. She is 21 years old and has scars from her neck down that will constantly remind her every time she looks in the mirror.

    This court has shown no compassion, it almost looks as if she is being charged with a crime, instead of being the victim. She has to go up on the stand and look at these evil people while the defendants attorney tries to discredit her. Antionette was stabbed across her throat, this has made her voice change and she is hard to understand.

  4. I agree, I too know Ms Bell and even if I didn't, it is rediculous how the courts are run in this town. Being the victim of trespassers on my property and no rights to protect ourselves. Something must be done in the county it is horrible!
    I can only hope and pray that Ms Bell can get thru this

I don't know this person, however, I did expierence pahrumps court system and nothing but corrupt lieing cops, a dispatcher who didn't do her job correctly and a judge who doesn't even read transcripts of whom is dead now. Good. I would still like to bring civil charges up against the state of Nevada for allot of things which pertained to a situation that Jason earnest was my attorney on. He's also one stupid idiot who shouldn't even be a lawyer. Anyway if u are interested in filing a charged against that ridiculous town email me please. Let's talk more. By the way the people that killed my brother to prove a point................I feel sorry for you becuse you have no clue who the Maxwells are. Not say................. you dumb fuck cops we have been telling you for a year what was going to happen you would not listen. Maybe if you would have listened to us when we told you, Willie would still be alive. You (the cops) still have our numbers we hope, call us, we both told you a year a go..............Typial now we have lost our broter, our dad and our grandpa...................no drugs in his life.   6. I am so sorry you are going thru this. No one is saying Mike did anything wrong, we are just saying that the cops and courts suck in this town. Please keep up the fight to help all of us get rid of the corruption here......Good Luck with his trial. I have actually met him and he does seem like a nice guy.

    Obviously her incoherent speech is enough evidence to suggest drug use. If it was just pain meds this would show in a drug test and all is good. The problem is it is a small town and the whole court room is onto the fact this girl has had a drug problem that stems back to her adolescent years. Her and her mother. I understand getting stabbed was not her fault; except for the fact she was an adult by this time and could have left the game at anytime. No she choose to keep using and giving it up to junkie men for exchange of drugs. Yes; our town has quite a bit of corruption problem, but this is a case where all evolved should have been put in jail along time ago, Especially the mom. The problem one might suggest is the child protection agencies in this state are crap and here in Pahrump they are much worse than that. The kids here have a raw deal. Lots of crack heads trying to raise children; when the state comes in they remove the child, and here in Pahrump they put them in a home where 9 times outta 10 it is worse than the home they were removed from . So is it Antoinettes fault she is a crack head......NO! but she is what she is. I am grateful that the littlest addition of that family is not there and is being raised in a loving well structured home. She has evolved from a Hellin Keller monster to an intelligent beautiful little girl.

  8. Yeah, Gensler is a snake. He was supposed to defend me and lied to me get me to take a lesser charge and I ended up doing time for taking my own car back from someone who stole it from me and forged the title. He laughed at me after the sentencing when I freaked out over the time I got even though he promised that if I signed the paper I'd be set free. He is scum.
