Nye County Murder Update: Guilty

From the Pahrump Valley Times:
Jurors convicted Daniel Robbins in the Aug. 18, 2011 murder of Chris Mundy Tuesday evening.
Robbins will be sentenced on Feb. 11 on charges of second degree murder with use of a deadly weapon, two counts of assault with a deadly weapon and a single battery with a deadly weapon charge.
He faces a maximum life in prison and a minimum of at least 10 years for the murder alone. With weapon enhancements and the other felony charges, he could spend the next two decades or more behind bars....

Clearly, there are some jurors in Nye County who are like the Scarecrow in the "Wizard of Oz"- they don't have a brain.
My guess is that this verdict will be overturned, either at the Nevada Supreme Court or in Federal Court.  Too many issues were let in that should not have and probably the jury instructions combined with a prejudiced newspaper that was allowed to print biased articles while the trial was on-going.
What a shame that a man was found guilty of murder after a punk kid comes on to his property without permission, during a volatile family situation, and after making threats to the family on Facebook, refuses to leave after a warning shot was fired and then stays in his car in the dark.  And that punk kid isn't responsible for his own death?
Idiot judge and idiot jurors.

  2. It's good to read an honest assessment of this nightmare. Too many people are quick to judge based on what "they would have done" or "what Danny should have done" etc. Let some of these jokers be thrown into a volatile situation in the moment, in live time, and SEE what they would do, especially with the back story what it was. It's easy to sit behind a computer or even deliberate in the jury room and pass judgment based on skewed information, without actually being in Danny's shoes.

    In saying this, I am not discounting the "punk kid's" death one bit. However, he was given ample warning before he drove up to the property and also received a warning shot, and he chose to ignore all of this in favor of trying to show how big a man he was. It was his choice alone to take the inherent risks, and unfortunately this choice eventually cost him his life.

    I, too, have followed this blog during the trial and have been impressed by the guts it takes to speak the truth. I certainly stick behind the Robbins family in the effort to get this miscarriage of justice overturned so that Danny can resume his life with his wife and family.

  3. Nice to see that someone is willing to print the truth about this situation. Also worth noting, Tammy Flores, the mother of Pablo, followed a juror into the bathroom shortly before deliberation. That should at least be enough for another trial if not something more.

  4. I dont know what happened yesterday---but the jury should have aquitted Danny!! In my opinion the 14 yr olds mother should have been brought up on child endangerment!!! I mean really what kind of mother lets a 14 yr old child go out @ 1:30 am with a 21 yr old man!!??!!?? Especially knowing what could happen!! The Robbins are an AWESOME family and dont deserve this.....

  5. Thanks for everyone's comments. It is a shame about the verdict and it seems like Robbins was fighting a system that deemed him guilty before trial. From Judge Wanker's comments, to the the bail issue to the PVT and during the trial.
    I think the trial lawyer screwed up by not demanding a jury from another county and not sequestering the jury.
